by StepParent for Partial Custody against Respondent, __________________, and in support

thereof, avers the following:

1. Petitioner (``Step-Father/Step-Mother'') currently resides at __________________,

2. Respondent (``Mother/Father'') currently resides at __________________,

3. Mother/Father filed for divorce on __________________.

4. Petitioner avers, that, in addition, he/she stands in loco parentis to [name] (the ``Child''), born

__________________.

5. Since the parties were married on __________________, Petitioner has assumed the

status of parent as to Child and has discharged parental duties toward him/her.

6. Petitioner and Child have formed a close and loving bond. Child has assumed Petitioner's

family name and has enrolled in school and other activities under that name. Child also calls

Petitioner ``Dad''/``Mom.''

7. Petitioner takes a parental interest in Child, regularly attending his/her sporting events and

school activities, helping him/her with his/her homework, preparing meals for him/her, and

disciplining him/her.

8. Since the parties have separated, Mother/Father has interfered with Petitioner's having

partial physical custody time and having communications by phone or otherwise with Child.

9. Petitioner seeks partial physical custody of Child as this would be in the Child's best interest.

WHEREFORE, Petitioner respectfully requests that this Honorable Court enter an Order

awarding Petitioner partial physical custody of [name].
